Intellectual Property

The control of any intellectual property rights resulting from research undertaken by the awardee (Honours or PhD/Masters student) shall be in accordance with Clause 32 of the AJ Parker Cooperative Research Centre for Hydrometallurgy Joint Venture Agreement.

32. SCHOLARSHIP INTELLECTUAL PROPERTY
In relation to Scholarships awarded to students enrolled at:
(a) Curtin and Murdoch, the provisions set out in Schedule 4 will apply
(b) University of Queensland, the provisions set out in Schedule 5 will apply.

SCHEDULE 4
(Scholarship Intellectual Property in respect of students enrolled at Curtin and Murdoch)

1. In relation to a student:
(a) who has been awarded a Scholarship; and
(b) who performs tasks or undertakes research related to, or in any way connected with, a Project in respect of which one or more Participants have entered into a Project Agreement, (a "Student"), the Scholarship Intellectual Property and all other rights of the Student in respect of the Project (including without limitation) the right of the Student to publish material related to, or in any way connected with, the Project will be determined by the provisions of that Project Agreement.
2. The university at which the Student is enrolled will procure, and be responsible for ensuring, that the Student complies with the provisions of the Project Agreement relating to the ownership of Scholarship Intellectual Property, to restrictions on publication and all other matters relating to, or in any way connected with, the Student's participation or involvement in the Project.
3. If:
(a) a student has not been awarded a Scholarship;
(b) a student does not:
  (i) perform tasks; or
  (ii) undertakes research related to, or in any way connected with, any Project; or
(c) the Project, in respect of which the student performs tasks or undertakes research tasks is not one in respect of which one or more Participants have entered into a Project Agreement, then the Scholarship Intellectual Property will be owned and the rights of the student to publish material related to, or in any way connected with, the project will be determined in accordance with the intellectual property policy of the university at which the student is enrolled.
